Amendments to the Federal Data Protection Act and the effect thereof on companies - Part 5
Section 3a BDSG new version urges compliance with the data economy objectives. From now on, personal data is to be anonymized or pseudonymized as far as possible for the intended purpose and where this does not incur disproportionate effort in regard to the protective purpose. Presently, the basic principle is that this option must be utilized. This constitutes a considerable tightening of the processing guidelines applicable today in order to reduce risks during the processing of personal data. Accordingly, options provided by modern hash functions and encryption technologies must be applied and used in full. It will come as a surprise to many companies that the apparent additional outlay for the use of these procedures will considerably simplify the administration of data protection and IT security, resulting in cost savings.
